Are you aware of the your legal obligations as an employer on Employee Legal Awareness Day?
What are the legal implications of getting it wrong?

The ATO says as an employer you need to:

  • Check the potential worker is legally allowed to work in Australia – register as an employer of working holiday makers if necessary.
  • Decide whether they will be an employee or contractor.
  • Register for PAYG withholding straightaway.
  • Select a default super fund, make sure you’re set up to report and pay super electronically using the SuperStream standard.
  • Set up a system to manage payments and keep records of your workers. (Securely)
  • Register for fringe benefits tax (FBT) if you’ll be providing fringe benefits to your employees or their associates.
  • Check if you need to register for payroll tax in any state that you operate in.
  • Other obligations you need to consider are to use a fair and non-discriminatory recruitment process that supports working parents, and people with a disability or caring responsibilities.
